Through the cracks: In June, Marc Ferrara, 43, was convicted in Jersey City, N.J., in the 1982 hammer-beating death of his girlfriend, but perhaps because of testimony that the victim had hit Ferrara first, the jury found him guilty only of aggravated manslaughter instead of murder. However, unknown to the jury, the state supreme court had ruled in 1993 that the manslaughter statute in effect in 1982 was subject to a five-year statute of limitations (since changed), which meant that Ferrara could not be convicted, and, thus, he walked free.

The event occurred during a period of 9 minutes and 35 seconds beginning at 11:48 a.m. local Mars time, recording the dust devil's progress in a northeasterly direction about 1.0 kilometer (0.62 mile) away from Spirit's perch on the slopes of the "Columbia Hills." The whirlwind was traveling at about 4.8 meters per second (16 feet per second) and covered a distance of about 1.6 kilometers (1 mile).

Contrast has been enhanced for anything in the images that changes from frame to frame, that is, for the dust devil. The dust devil is about 34 meters (112 feet) in diameter.

The Wingman

From the Hollywood Reporter comes this news:

According to The Hollywood Reporter, Rob McKittrick is swooping in to direct The Wingman for New Line Cinema. Written by Jon Hurwitz and Hayden Schlossberg, the romantic comedy centers on a man who, as a "wingman," is uncannily gifted at helping his friends pick up women. When he finally falls in love, it's with the one woman who can resist his powers.

McKittrick's directorial debut, Waiting, which he also wrote, is slated for release from Lions Gate in October. The film stars Ryan Reynolds, Anna Faris, and Justin Long. McKittrick also is writing and directing Mancrush at New Line.

You may be able to exclude your gain from the sale of a home that you have used for business or to produce rental income. But you must meet the ownership and use tests.

Example 1.

On May 29, 1998, Amy bought a house. She moved in on that date and lived in it until May 31, 2000, when she moved out of the house and put it up for rent. The house was rented from June 1, 2000, to March 31, 2002. Amy moved back into the house on April 1, 2002, and lived there until she sold it on January 30, 2004. During the 5-year period ending on the date of the sale (January 31, 1999 – January 30, 2004), Amy owned and lived in the house for more than 2 years as shown in the following table.

William owned and used a house as his main home from 1998 through 2001. On January 1, 2002, he moved to another state. He rented his house from that date until April 30, 2004, when he sold it. During the 5-year period ending on the date of sale (May 1, 1999 – April 30, 2004), William owned and lived in the house for 32 months (more than 2 years). He must report the sale on Form 4797. He can exclude gain up to $250,000. However, he cannot exclude the part of the gain equal to the depreciation he claimed for renting the house, as explained next.

Depreciation after May 6, 1997. If you were entitled to take depreciation deductions because you used your home for business purposes or as rental property, you cannot exclude the part of your gain equal to any depreciation allowed or allowable as a deduction for periods after May 6, 1997. If you can show by adequate records or other evidence that the depreciation deduction allowed was less than the amount allowable, the amount you cannot exclude is the amount allowed.

Example. Dan sold his main home in 2004 at a $10,000 gain. He meets the ownership and use tests to exclude the gain from his income. However, he used one room of the home for business in 2003 and claimed $1,000 depreciation. He can exclude $9,000 ($10,000 – $1,000) of his gain. He has a taxable gain of $1,000.

Bleeding a radiator

Sometimes, when heating radiators start making weird noises, you need to bleed them (finally found out what the English term is ;) ), and I hate doing it. But I have a central heating system that requires me to do it about once a month in winter, so I have to do it. At first, I did it with a cup and the super-tool everyone has: a square kind of key. CORAL SPRINGS, Florida (AP) -- A Goodyear blimp crash-landed Thursday night in an industrial park, authorities said. The two people on board were not injured.

The "Stars & Stripes" blimp went down shortly after taking off from Pompano Beach Air Park, where it is based. Both people onboard were trapped briefly while electrical crews cleared the site, authorities said.

The blimp lost most of its helium and was draped across some orange self-storage units in the industrial park. It's nose remained pointed into the air.

Bad weather may have forced the blimp down. There were thunderstorms in the area at the time, authorities said.

The Federal Aviation Administration was investigating.

"It went right over our building and was making really loud noises," said Maryann Clark, general manager of a nearby restaurant.

The blimp is one of three Goodyear blimps based in the United States. Goodyear leases about 32 acres at the air park as a blimp base, according to the park's Web site.

Disney Animation Arm Adds Depth with 5 New Films

LOS ANGELES (Hollywood Reporter) – Walt Disney Feature Animation has made its first public recruiting pitch to the animation community in four years with executives from the studio unveiling five films on which they are working. They also showed off the animation tools they are using as Disney makes the transition from traditional 2-D pen-and-ink animation to 3-D computer animated features. A team of Dis-ney executives on Tuesday made an impassioned plea for the Los Angeles Professional Chapter of ACM SIGGRAPH – the area's premiere computer graphics artists – to join the animation studio during a ses-sion at the ArcLight cinema complex in Hollywood. The program included preview material from five 3-D computer animated movies in the pipeline, which will comprise the studio's homegrown animation slate through 2008.

? Nearly 10 minutes of scenes and set pieces from "Chicken Little" demonstrated how Disney is tack-ling such technical and artistic computer animation challenges as fluid simulations, chicken feathers and fur, subjected to sophisticated wind modules.
? The Disney team touted the company's new Glendale-based computer animation building, which is earmarked for "Toy Story 3" production, which Disney is proceeding with under its contractual right to produce sequels to the Pixar films. The story follows Buzz Lightyear as he is recalled to Taiwan af-ter a series of malfunctions. Learning of a product-wide recall, all the toys in Andy's room, under Woody's leadership, head to Taiwan to save Buzz from doom.

A second project, tentatively titled "A Day With Wilbur Robinson," based on the book by William Joyce, follows a time-traveling 12-year-old orphan who hooks up with a 13-year-old kid from the fu-ture in settings that recall 1930's "Metropolis" and the cartoon television series "The Jetsons." The project stars stylized young human protagonists and a mustachioed and bowler-capped villain.

Ten minutes of rough story boards, hand-drawn animatics, and raw computer animation were shown from the tentatively titled "American Dog," from director Chris Sanders ("Lilo & Stitch"), which is scheduled for release in 2007. Sanders' canine, a TV star, drinks martinis with starlets and showboats on sets until he is suddenly abandoned in his trailer in the Nevada desert where he meets up with a radioactive rabbit and a one-eyed cat who are trying to find new homes.
? Also shown were brief test shots from "Rapunzel Unbraided," scheduled for release in 2008. Long-time Disney animator Glenn Keane, best known for animating the Beast in 1991's "Beauty and the Beast," is making his directorial debut with the movie starring a computer-animated princess.

For children of the '80s, they were toy-store celebrities who forced parents to queue up at dawn or fight for products in aisles across Amer-ica. Now, BackPack Toys is hoping that Ruxpin, like the Bears and Kids before him, can ride a wave of nostalgia into the toy bins of a new generation. And independent The Ad is charged with helping him get there. The Ad Store's two-pronged attack will use print ads to lure adults and TV to target children. First work is expected to break in August. Ruxpin has enjoyed swift trading on eBay, and 85 percent of adults who owned the toy as kids still recognize the brand. Ruxpin, which debuted as a Worlds Of Wonder toy in 1985, is due to re-launch in September – most notably in 2,000 Target stores. MP3 cartridges have re-placed his original cassette tapes, but Teddy Ruxpin's animatronic eyes and mouth will move in trade-mark fashion as he narrates a series of stories about the land of Grundo.

You get two different recording buttons on this unit — one for stills and one for video — and you can even take stills while recording video up to 640 x 480 at 30 frames per second. Not too shabby for a camera 0.63 inches thick.

(E! OnLine) – The Simpsons movie is off the drawing board and in preproduction. "You know what? We've just done the table read for The Simpsons movie, so although we've been promoting that we're going to do it, now we're actually doing it and are in production," Nancy Cartwright, who gives voice to Bart Simpson, told BBC Radio 1 this week. Cartwright indicated that the movie is still in the preliminary script development stage and it will take at least two years before it's fully animated and ready for release. Producers had always indicated that the movie would likely debut after the TV show ran its course. But with the show continuing to perform well, averaging about 10 million viewers last season, the Simpsons brain trust decided to move forward now, according to a rep for 20th Century Fox, which will distribute the Simpsons film. Rumors of a Simpsons movie seem to surface every few years, usually sparked by the 'toon's mastermind, Matt Groening, which then sends long-time Homer honks into a frenzy of anticipation. But such talk turned out to be premature in the past. The closest The Simpsons has come to the big screen was a computer-generated Homer cameo for the 2000 IMAX 3-D flick, CyberWorld. This fall will see The Simpsons embark on season 17. Fox and show producers foresee the cartoon cast fulfilling its current contract, which runs through a 19th season.
